Welcome to SPARKMAKER.CO, the digital home of Sparkmaker LLC. These Terms are a binding legal agreement between you and Sparkmaker LLC, the company that owns and operates this site. They are legally enforceable and designed to protect both you and Sparkmaker—so our work together can be clear, fair, and aligned.
By using this site and accessing any of our programs, services, or content, you’re agreeing to a few ground rules. If you don’t agree, we kindly ask that you don’t use the site.
We may update these terms at any time, and will post any changes here—whether or not you receive separate notice. We’ve written everything in clear language so you can understand what you’re agreeing to and what your rights and responsibilities are.

1.0 Scope & Structure of These Terms
These Terms of Use (“Terms”) are the master agreement between you (“User,” “Member,” “Participant,” or “Client”) and Sparkmaker LLC (“Sparkmaker,” “we,” “our,” or “us”). By accessing or participating in any Sparkmaker product, service, course, membership, tool, live experience, or community (collectively, the “Services”), you agree to be legally bound by these Terms.
These Terms apply broadly to all Sparkmaker offerings, whether delivered through our website, gated course areas, live or recorded calls, community platforms (such as Mighty Networks), or other digital tools we may use. In some cases, we may provide product-specific addenda (“Addenda”) that include additional details about deliverables, payment terms, or access rights. If there is a conflict between these Terms and an Addendum, the Addendum will control for that specific product or service; otherwise, both apply together.
By proceeding with payment, enrollment, or use of any Sparkmaker Service, you confirm you have read, understood, and agreed to these Terms in full.
2.0 Privacy Policy & Disclaimers
Our Privacy Policy and Disclaimers are incorporated into these Terms and apply to all use of Sparkmaker Services. By using our Site or enrolling in any program, you consent to the practices described in those policies.

Together, these documents form part of your agreement with Sparkmaker.
3.0 Site Services, Acceptable Use, & Community Use
We agree to provide you with access to this Site and its related programs, community spaces, and services (collectively, the “Service”) operated by Sparkmaker LLC. In exchange, we ask that you follow a few ground rules:
3.1 Minimum Age & Responsible Use
You must be at least 13 years old to use this site. If you're located in the EU, the minimum age is 16. If you’re under 18, your parent or legal guardian must agree to these terms on your behalf.
Don’t use this site or any connected platform to break the law or violate our terms.
Don’t alter the site, introduce malware, or do anything that interferes with how it functions.
Don’t disrupt the experience for others—be respectful of how others use and enjoy this space.
Don’t encourage anyone else to break these rules.
Use your common sense, and be a good human. You’re responsible for anything you do on the site under your login.
3.2 Prohibited Uses
Don’t try to hack into the site, access other users’ accounts, or mess with our systems or servers.
Don’t use this space to send spam, advertise without permission, or scrape info for your own use.
And absolutely no fraud, misrepresentation, or shady business. That’s a hard no.
Don’t knowingly introduce viruses, worms, logic bombs, or other malicious code.
Don’t attempt to gain unauthorized access to our servers, software, or any system connected to this site.
Don’t engage in denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks.
Don’t reproduce, sell, or misuse our content in ways that breach our Terms or intellectual property protections.
Don’t use the site in any way that could harm Sparkmaker, its users, or its reputation.
3.3 Contributions & Community Engagement
If you access our private programs or community via Mighty Networks (or a similar platform), we’re committed to maintaining a respectful, supportive, and intentional environment. You agree not to:
Post anything violent, threatening, harassing, or intended to intimidate.
Share or promote illegal activity, hate speech, or the sale of prohibited or controlled substances.
Post content that is sexually explicit or promotes commercial sexual services.
Share someone else’s personal or private information without their consent.
Upload anything that infringes on copyright, trademarks, or intellectual property that you don’t own or have permission to share.
Impersonate another person or create an account using someone else’s identity.
Use someone else’s login, or share your own credentials.
Use bots, scrapers, or automated tools to access the site or send unsolicited messages.
Attempt to register again if your previous account was removed for violating these terms.
Create an account if you are otherwise prohibited by applicable laws or regulations.
Post or share content that is knowingly false, misleading, defamatory, obscene, hateful, or discriminatory.
Post or imply anything that falsely appears to be endorsed by Sparkmaker if it isn’t.
Submit content that breaches legal duties (like confidentiality obligations) or invades others’ privacy.
We may also view, store, or redistribute content shared in public areas of the site or community as reasonably needed to operate our business.
3.4 Moderation & Enforcement
We reserve the right (but are not obligated) to monitor and moderate content submitted through our programs or platforms.
We may remove or restrict content or accounts that violate these terms without prior notice.
If an interactive feature (like commenting or community posting) is ever moderated, we’ll clarify whether it’s done manually or automatically.
Children under 18 must be supervised if using any interactive elements of the site or community.
We’re not liable for content or conduct from other users, but we will do our best to maintain a respectful environment.

3.5 Violations & Consequences
Violations of these terms may result in suspension or removal from our site, services, or community at our discretion. We also reserve the right to take legal action if necessary. We are not liable for any loss or damage caused by your actions or by other users who violate these terms.
3.6 Updates to This Policy

4.0 Access to Courses, Memberships & Services
4.1 Eligibility
While the Site may be accessed by users 13 years or older (with parental/guardian consent if under 18), enrollment in Sparkmaker courses, memberships, coaching, or other paid Services is limited to individuals who are 18 years or older and legally able to enter into binding contracts. By enrolling, you represent that you meet these requirements. See our Privacy Policy for more on age and data restrictions and eligibility.
4.2 Enrollment & Account Access
Upon enrolling in a Sparkmaker course or membership, you will receive login credentials to a password-protected area or community platform (such as Mighty Networks or similar tools). This area may include live and recorded calls, video or audio lessons, worksheets, templates, or other resources. You agree to keep your login credentials private and not share them with anyone else.
4.3 Duration of Access
Unless otherwise stated at the time of purchase, you will have access to course or membership materials for as long as the program area exists, subject to these Terms. If Sparkmaker intends to close a course or membership portal, we will provide at least 30 days’ notice and the ability to download available resources before closure. Marketing language describing “lifetime access” means access for the life of the program portal—not your lifetime.
4.4 Program Components
Your enrollment may include access to community spaces, live or recorded group calls, coaching sessions, and/or accountability partnerships, depending on the program purchased. Details of what’s included will be described on the relevant sales page or enrollment materials. We reserve the right to modify, pause, or discontinue specific program features at any time.
4.5 Termination of Access
We may suspend or revoke your access to any Sparkmaker program, membership, or community if you violate these Terms, disrupt the experience for others, or fail to complete required payments. In such cases, you will not be entitled to a refund and you remain responsible for any outstanding balances, unless otherwise provided by our Refunds & Payment Collection policy (see Section 13.0).
4.6 Individual Sessions
Certain Sparkmaker programs may include limited 1:1 sessions between you and Sparkmaker as part of the overall package. These sessions are provided as a supplement to the program and do not create a separate coaching engagement outside of your enrollment.
All 1:1 sessions are educational and developmental in nature. They are not medical, mental health, legal, or financial advice, and should not be relied upon as such. Any decisions you make as a result of these sessions remain your sole responsibility. See our Privacy Policy & Disclaimers for more on professional limitations.
5.0 Community & Live Call Standards
5.1 Respectful Participation
Our community spaces and live calls are designed to be collaborative, supportive, and productive. By participating, you agree to:
Show up respectfully—listen, contribute thoughtfully, and avoid dominating or derailing discussions.
Allow all participants to have space to share.
Use professional and considerate language and behavior at all times.
5.2 Confidentiality in Group Settings
What’s shared in Sparkmaker community spaces or live calls stays in those spaces. You agree not to disclose, record, or distribute other participants’ personal stories, experiences, or confidential information outside of the program unless you have received that participant’s explicit written permission to do so. Respecting privacy is essential to building trust.
5.3 Recordings & Replays
Sparkmaker may record live calls, workshops, or group coaching sessions for the purpose of making replays available to participants or for internal training. By participating, you consent to being recorded. If you prefer not to appear on video or audio, you may choose to keep your camera and/or microphone off. Replays are for enrolled participants only and may not be shared outside the program. For details on how recordings and user-generated content may be used, see our Privacy Policy & Disclaimers.
5.4 Accountability Partners & Group Activities
From time to time, we may pair participants with accountability partners or facilitate group activities. These are optional and intended to enhance your experience. Sparkmaker does not perform background checks on participants and is not responsible for their actions. Use your best judgment in sharing information and set healthy boundaries with partners.
5.5 Removal for Disruptive Conduct
We reserve the right to mute, remove, or restrict access for any participant who engages in behavior that is disruptive, disrespectful, or violates these Terms. Removal may apply to a single call, the community platform, or the entire program, depending on the situation. If you are removed for violating standards, you are not entitled to a refund and remain responsible for any outstanding payments (see Refunds & Payment Collections).
6.0 Confidentiality
6.1 Sparkmaker Content
All program materials—including frameworks, worksheets, videos, recordings, and coaching tools—are proprietary to Sparkmaker LLC. You agree not to share, copy, or distribute these materials outside of the program, except with Sparkmaker’s prior written consent. See our Privacy Policy & Disclaimers for more on how our intellectual property and content may be used.
6.2 Participant Privacy
You agree to respect the privacy of other participants. Stories, strategies, and personal information shared within Sparkmaker programs are considered confidential and are not to be shared, published, or distributed outside of the program unless you have received that participant’s explicit written permission to do so. 6.3 Group Environment
Confidentiality is essential for maintaining a supportive environment. While we encourage openness in group settings, you are responsible for choosing what you share. Sparkmaker is not responsible for the actions of other participants, but we take violations of confidentiality seriously and may remove anyone who breaches this trust.
6.4 Exceptions
Nothing in this section prevents Sparkmaker from using anonymized insights for internal learning, training, or marketing purposes, or from sharing content when legally required. See our Disclaimers for more on testimonial use and results disclaimers.
7.0 Your Rights
7.1 Right to a Safe Environment
You have the right to use this Site and related Services in a respectful and intentional environment. We are committed to maintaining systems that protect your experience and will take reasonable steps to prevent misuse or harmful conduct.
7.2 Right to Privacy
You have the right to understand how your personal data is collected, used, stored, and protected. Please refer to our Privacy Policy (sparkmaker.co/privacy-policy) for detailed information on how we handle personal data in accordance with applicable privacy laws.
7.3 Public vs. Private Submissions
If you choose to engage with Sparkmaker through public-facing channels—such as blog comments, social media, or open community forums (including public threads on Mighty Networks)—please note that those submissions are not considered confidential. We may view, store, moderate, republish, distribute, or otherwise use such content as reasonably necessary in the course of our business and in accordance with United States law.
Any personal content you submit through private channels—including contact forms, Spark Session applications, direct emails, or uploaded exercises and assignments (via Google Docs, Mighty Networks, or other tools we use to deliver our program content)—is considered confidential unless you provide explicit permission otherwise. We do not share, distribute, or republish this content and handle it in accordance with our Privacy Policy.
If you grant us written or recorded permission to share your feedback, testimonial, or submitted work for marketing or educational purposes, you provide Sparkmaker LLC with a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with our business. See our Disclaimers for more on how testimonials are used and why individual results vary.
You also agree not to submit or transmit any content—public or private—that is illegal, harmful, defamatory, obscene, abusive, fraudulent, or otherwise unlawful or in violation of another person’s rights.
7.4 Right to Account Deletion (EU Residents)
If you reside in the European Union or are otherwise covered by data protection regulations such as the GDPR, you have the right to request the deletion of your account and associated personal data. You may do this by contacting us directly or through available account settings.
Please note that public or shared content (e.g., community posts) may remain visible if reposted or quoted by others. We may retain limited data as required for legal compliance, fraud prevention, recordkeeping, or legitimate business operations.
7.5 Responsibility for Account Activity
You are solely responsible for all activity conducted under your login credentials. This includes, but is not limited to, all content posted, uploaded, or transmitted through your account. You must only share content that you own or have the legal right to use and distribute, including written material, images, video, music, or other intellectual property. If you post or share content that violates another party’s legal rights (including copyright, privacy, or contractual obligations), you assume full liability for any resulting claims, damages, or legal action. 8.0 Our Rights
8.1 Limitation of Responsibility
We are not responsible for:
Links to third-party websites or companies, even if they appear on our Site.
The results of connecting your Sparkmaker account to third-party services (e.g., posting content on social media or sharing via integrated platforms). You are subject to the terms and privacy policies of those third parties.
Any data, mobile usage, or connectivity charges you incur while accessing our Site or Services.
The misuse, copying, or unauthorized distribution of our content by others. While we take steps to protect our materials, we cannot guarantee enforcement against all violations.
Reliance on information shared by guests, speakers, or other participants. Content from third parties reflects their own views and Sparkmaker does not guarantee its accuracy or completeness. See our Disclaimers for more on professional advice, guest content, and results disclaimers.
8.2 Termination & Content Removal
We reserve the right to:
Suspend or terminate access to the Site or any related Services at any time, for any reason, and without prior notice.
Remove, restrict, or delete any content you submit or upload—whether or not it violates our policies—at our sole discretion.
Decline to compensate you for any loss, including financial, resulting from content removal, account suspension, or Site discontinuation.
8.3 Usernames & Account Restrictions
We may require you to change your username at any time and for any reason, including to prevent confusion, impersonation, or brand conflict. We may also restrict or limit access to certain account features based on your behavior, use history, or compliance with these Terms.
8.4 Reservation of Rights
All rights not expressly granted to you in these Terms are reserved by Sparkmaker LLC. We may update, modify, or discontinue any aspect of our Services at our sole discretion.
9.0 Intellectual Property Rights
9.1 Ownership
All images, text, designs, graphics, trademarks, service marks, videos, recordings, written materials, frameworks, slides, guides, workbooks, templates, and coaching tools are owned by Sparkmaker LLC or the properly attributed party. All rights are reserved.
9.2 License to Use
When you enroll in a Sparkmaker program or access our Services, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use the materials solely for your own personal education and development. You do not gain ownership of any content, and your license ends if you are removed from the program or your access otherwise expires.
9.3 Restrictions
You may not:
Copy, screenshot, share, republish, distribute, or otherwise make available Sparkmaker content without written permission.
Modify, translate, or create derivative works of Sparkmaker materials.
Remove branding, alter, or claim any content as your own.
Sell, resell, or commercially exploit Sparkmaker content, including incorporating it into your own programs, services, or business offerings.
9.4 User-Generated Content
By posting or submitting content in Sparkmaker communities, coaching calls, or other interactive spaces, you grant Sparkmaker a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute that content in connection with the program. If we wish to use your submissions for marketing purposes (such as testimonials), we will request and document your explicit permission. 9.5 Enforcement
Unauthorized use of Sparkmaker intellectual property may result in immediate termination of your access and may subject you to civil or criminal liability. We reserve the right to pursue damages or injunctive relief to protect our rights.
9.6 Restrictions on Use of Sparkmaker Materials with AI
You may not input, upload, or otherwise submit Sparkmaker’s proprietary content—including course materials, frameworks, worksheets, community discussions, coaching session transcripts, or any other resources provided through the Services—into third-party artificial intelligence (“AI”) or machine learning tools.
This restriction exists to prevent Sparkmaker’s intellectual property from being used to train, inform, or generate derivative works through AI systems, and to maintain the confidentiality and integrity of program materials. Any attempt to use Sparkmaker’s proprietary content in this way is a violation of these Terms and may result in immediate termination of your access, as well as legal action.
9.7 Permission Requests
We understand some sharing comes from genuine enthusiasm. If you’d like to request permission to share Sparkmaker content, please reach out to us first at SUPPORT@SPARKMAKER.CO.
10.0 This Agreement
10.1 Third-Party Services
If you use third-party services through the Site (such as payment processors or integrations), you will also be subject to their terms and policies. If there is ever a conflict between their terms and these Terms, the third-party terms will control for those specific services.
10.2 Third-Party Services
If any part of this Agreement is found to be unenforceable by a court of law, the rest will continue in effect. The remaining terms remain valid and enforceable.
10.3 No Waiver
Any changes to these Terms must be made in writing. If we do not enforce a part of this Agreement at any point, it does not mean we waive our right to enforce it in the future. Our inaction does not constitute a waiver of our rights.
10.4 Reservation of Rights
We reserve all rights not expressly granted or described in these Terms.
10.5 Parties to the Agreement
This Agreement is between you and Sparkmaker LLC only. No other party has any rights under it.
10.6 Transferability
You may not transfer your rights or responsibilities under this Agreement to anyone else without our written consent. We may transfer our rights and obligations if needed—for example, in the case of a business sale, restructuring, or legal requirement.
11.0 Advertising, Affiliates, and Testimonials
11.1 Advertising & Third Parties
Sparkmaker may feature third-party links, resources, or tools as part of our Services. These are provided for convenience only. We do not control or endorse third-party sites, and we are not responsible for their content, policies, or practices. Your use of third-party tools or sites is governed by their own terms and privacy policies. See our Privacy Policy for more on how advertising and remarketing technologies may be used.
11.2 Affiliate Relationships
From time to time, Sparkmaker may include affiliate links or recommendations for products or services. This means we may earn a commission or other benefit if you make a purchase through those links. We only promote affiliates we believe provide value, but you acknowledge that it remains your responsibility to evaluate whether any product, service, or resource is right for you.
11.3 Testimonials & Endorsements
Testimonials and success stories featured on our Site, in our programs, or in marketing materials reflect the real experiences of Sparkmaker participants. However, they are individual results and are not intended to guarantee that any current or future participant will achieve the same outcome. Your results depend on your own effort, commitment, and circumstances. See our Disclaimers for more on testimonial use and results disclaimers.
11.4 No Endorsement
Any mention of third-party tools, platforms, or services does not constitute an endorsement by Sparkmaker.
12.0 Use of AI Tools
12.1 AI Tools In Services
From time to time, Sparkmaker may provide resources or materials that are generated or assisted by artificial intelligence (“AI Tools”), whether proprietary or integrated from third-party providers. All provisions regarding third-party platforms in these Terms also apply to AI Tools.
12.2 Ownership and License
Unless otherwise noted in a specific program addendum:
Any prompts, frameworks, or templates Sparkmaker develops remain the intellectual property of Sparkmaker LLC.
You may use AI-generated outputs provided through Sparkmaker Services for your personal or internal business use only.
You may not resell, redistribute, or incorporate AI outputs into products, courses, or client work without Sparkmaker’s written consent.
12.3 Accuracy and Limitations
AI outputs may contain inaccuracies, outdated information, or biases and are not guaranteed to be complete or error-free. They should not be relied upon as professional, legal, financial, medical, or mental health advice. You remain responsible for reviewing and verifying any AI-generated materials before use.
12.4 Compliance and Restrictions
You agree not to input or upload sensitive personal data, protected health information, trade secrets, or confidential information into any Sparkmaker-provided AI Tool. You are solely responsible for ensuring that your use of AI outputs complies with applicable laws, regulations, and platform rules.
12.5 Limitation of Liability
Sparkmaker disclaims any liability for damages, losses, or claims arising from AI-generated outputs or your reliance on them. Your use of AI outputs is entirely at your own discretion and risk.
13.0 Refunds & Payment Collection
13.1 Payment Authorization
By enrolling in a Sparkmaker course, membership, or program, you authorize Sparkmaker LLC (through Stripe or other secure processors) to charge your chosen payment method for the full amount according to the payment option selected at checkout. You are responsible for ensuring that your billing information is accurate and current.
13.2 Payment Plans
If you select a payment plan:
All installments must be paid in full, regardless of participation, completion, or satisfaction with the Services.
You authorize automatic recurring charges according to the agreed schedule.
Failed payments must be remedied within five (5) calendar days of notice. Repeated failed payments may result in suspension of access and referral of the balance to collections.
Suspension or termination for non-payment does not cancel your obligation to complete the payment plan.
13.3 Delivery of Services & Responsibility
Enrollment grants you access to digital materials, live or recorded sessions, and/or booking links for any included 1:1 sessions once the program period begins. Delivery of access constitutes full delivery of the Services. It is your responsibility to attend scheduled calls, book any included 1:1 sessions within the program period, and make use of available resources. Failure to participate does not excuse payment obligations or entitle you to a refund.
13.4 No Withholding
You may not withhold, offset, or reduce payments for any reason (including dissatisfaction, disputes, or non-participation), unless required by law.
13.5 Refunds Policy
All sales are final. By enrolling, you are making a firm commitment to the program. A one-time exception applies: you have 24 hours after your initial payment to review these Terms and request a refund if you decide the program is not the right fit. After that period, no refunds or credits will be provided for any reason, except where required by law.
13.6 Chargebacks
Filing an unwarranted chargeback with your bank or card issuer is a material breach of these Terms. If you have a concern, you must first contact us at support@sparkmaker.co and allow seven (7) business days for resolution. Sparkmaker reserves the right to dispute any chargeback with documentation and to recover associated fees, costs, or damages.
13.7 Taxes & Currency
You are responsible for all applicable taxes, duties, and currency conversion fees. Payments must be made in the currency specified at checkout.
14.0 Limits on Liability
14.1 “As Is” Services
This Site and all Sparkmaker programs are provided “as is.” We cannot guarantee they will always be safe, secure, error-free, or available without interruption. Unexpected issues, mistakes, or vendor errors may occur despite our best efforts. TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES—EXPRESS OR IMPLIED—INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
14.2 Third-Party Content & Services
We do not control, direct, or take responsibility for what others do or say—online or offline—including offensive, unlawful, or inappropriate content shared by users. We are also not liable for services, platforms, or features provided by third parties (e.g., integrations, guest speakers, or outside companies), even if you access them through our Site. Always review third-party terms and policies before use. See our Privacy Policy for details on third-party providers and integrations.
14.3 Limitation of Liability
To the fullest extent permitted by law, the total liability of Sparkmaker LLC, its owners, officers, employees, contractors, agents, and affiliates (“Released Parties”) for any claim arising out of or relating to these Terms, the Services, or your use thereof, whether in contract, tort, or otherwise, shall not exceed the greater of: (a) $100 USD, or (b) the amount you actually paid to Sparkmaker in the twelve (12) months preceding the claim.
In no event shall the Released Parties be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:
Loss of revenue, profits, savings, or goodwill;
Business interruption or delay;
Loss of data, use, or opportunity;
Personal injury or emotional distress; or

These limitations apply whether or not such damages were foreseeable.
14.4 Indemnification
You agree to defend (at our request), indemnify, and hold harmless Sparkmaker LLC and its owners, officers, employees, contractors, agents, and affiliates (collectively, the “Released Parties”) from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or connected with your use of the Services or your violation of these Terms.
You will cooperate as reasonably required in the defense of any claim. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you may not settle any claim without our prior written consent.
This indemnification obligation will survive termination of these Terms and your use of the Services.

14.7 Force Majeure
Sparkmaker will not be liable or responsible for any failure or delay in performance caused by events beyond our reasonable control. These events may include, but are not limited to: natural disasters, acts of God, government actions, labor disputes, public health emergencies, internet or telecommunications outages, platform failures, or other disruptions outside Sparkmaker’s control.
In the event of a force majeure, Sparkmaker may reschedule or modify Services as needed. While refunds or credits are not guaranteed, we will use reasonable efforts to minimize disruption and ensure you continue to receive the value of your enrollment.
14.8 Allocation of Risk
You acknowledge and agree that the limitations set forth in this Section are fundamental elements of this Agreement. Sparkmaker would not be able to provide the Services on an economically reasonable basis without such limitations. These limitations shall apply even if any remedy fails of its essential purpose.
15.0 How We Will Handle Disputes
15.1 Initial Resolution

15.2 Arbitration Agreement
If a legal dispute arises, you agree to resolve it through binding arbitration administered by the American Arbitration Association (“AAA”). By agreeing to arbitration, both you and Sparkmaker waive the right to a jury trial and to bring or participate in class actions or other representative proceedings.
15.3 Exceptions to Arbitration
The following types of claims are not subject to arbitration and may be brought in court:
Claims in small claims court;
Disputes involving intellectual property rights (such as trademarks or copyrights);
Claims involving unauthorized use of or interference with our Services.
A court may still decide issues related to the scope or enforceability of these arbitration provisions.
15.4 Venue and Governing Law
For any claims not subject to arbitration or small claims resolution, you agree to resolve them exclusively in either:
The U.S. District Court for the District of Wyoming, or
A state court located in Wyoming.
You consent to the personal jurisdiction of these courts. These Terms are governed by the laws of the State of Wyoming, to the extent not preempted or inconsistent with federal law, without regard to conflict-of-law principles.

16.0 Contact & Support
16.1 Primary Contact Channel
All program-related inquiries, support requests, and account issues must be submitted in writing to support@sparkmaker.co. This ensures proper tracking and timely responses. Messages sent through personal social media accounts, direct messages, or other informal channels may not be received or acted upon.
16.2 Response Times
Sparkmaker aims to respond to most inquiries within two (2) to three (3) business days, excluding weekends and U.S. federal holidays. Complex issues requiring escalation, legal review, or third-party intervention may take longer.
16.3 Participant Responsibilities
You are responsible for:
Monitoring the email address associated with your Sparkmaker account for updates, deliverables, and support responses;
Providing requested information, documentation, or access credentials promptly;
Notifying Sparkmaker in advance if you anticipate delays in responding to support follow-ups.
16.4 Limitations on Support
Sparkmaker is not responsible for:
Missed deadlines, bonuses, or access expirations caused by delayed participant communication or incomplete deliverables;
Access issues caused by outdated or unsupported devices, browsers, or internet connectivity;
Issues resulting from third-party platform outages, policy changes, or account restrictions.
16.5 Scope of Support
Standard support includes help with accessing purchased Services, navigating program content, and clarifying timelines or policies. Support does not include business coaching, strategic consulting, or unrelated technical troubleshooting unless expressly included in your program tier.
17.0 Acceptance & Electronic Signature
By completing a purchase, checking a box indicating agreement to these Terms, or otherwise accessing any Sparkmaker program, course, membership, or service (collectively, “Services”), you:
Confirm you have read, understood, and agree to be bound by these Terms, including the Privacy Policy, Disclaimers, and any program-specific addenda incorporated by reference.
Consent to enter into this Agreement electronically, with the same legal force and effect as a handwritten signature.
Affirm that you are at least 18 years of age and have the legal capacity to enter into this Agreement.
Understand that continued access to or use of the Services constitutes ongoing acceptance of the then-current Terms, as they may be updated from time to time.
Acknowledge that all disputes will be resolved under the provisions of Section 14.0 (How We Will Handle Disputes) regarding arbitration, governing law, and jurisdiction.
